Marriage License Information

A marriage license is required to be legally married in Texas and the ceremony cannot be performed without it. It may be obtained at a county office and costs $60.00 for the state portion (waived with approved pre-marital counseling course) and a county portion of $21.00 (in Dallas County; other counties may vary). There is a 72-hour waiting period before the license is valid (with some exceptions), and is good for 90 days after it is issued.

What are the requirements for getting a formal marriage license?

1. Both parties must appear before the county clerk;

2. Submit the person's proof of identity and age;

3. Provide the information applicable to that person for which space is provided;

4. Mark the appropriate boxes provided in the application;

5. Take the oath printed on the application and sign before the county clerk.

What can I use as proof of identity?

1. Driver's license or identification card issued by this state or another state;

2. United States passport;

3. A current passport issued by a foreign country;

4. An original or certified copy of a birth certificate issued by a Bureau of Vital Statistic for a state or a foreign government. Must present a valid form of government issued ID;

5. Military ID card

6. Forms of identification cannot be mutilated (i.e., torn, taped together, or laminated).
